Return Policy

Return Policy and Right of Withdrawal

This Return Policy sets out the conditions and procedures for exercising the right of withdrawal and returning products purchased on bombola-exoticwhip.it, operated by Bombolawow (hereinafter also “Seller” or “we”).

2. Scope of application

The provisions on the right of withdrawal (Sections 3–7 of this Policy) apply exclusively to Consumers, i.e. natural persons acting for purposes outside their trade, business, craft or profession, pursuant to art. 3, paragraph 1, letter a) of Italian Legislative Decree 206/2005 (Consumer Code).

Business customers (B2B) — i.e. natural or legal persons purchasing within the scope of their business, commercial or professional activity — are not entitled to the right of withdrawal. For B2B customers, only the statutory warranty for defects of the sold goods (art. 1490 et seq. of the Italian Civil Code) applies, as described in Section 9.

3. Right of Withdrawal (Consumers only)

The Consumer has the right to withdraw from the contract, without giving any reason and without penalty, within 14 (fourteen) days from the date on which he or she physically receives the products or, in the case of multiple deliveries, from the date of delivery of the last item.

To exercise the right of withdrawal, the Consumer must inform us of the decision by means of an unequivocal statement (e.g. a letter sent by post or e-mail) sent to the contact details indicated in Section 1, before the expiry of the 14-day period.

The Consumer may use the model withdrawal form provided in Section 11, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that the Consumer sends the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

4. How to return the products

Once the withdrawal has been notified, the Consumer must return the products without undue delay and in any event no later than 14 days from the day on which the withdrawal was communicated.

We recommend contacting our customer service via e-mail in advance to receive operational instructions and, where applicable, a return authorisation number (RMA).

5. Return shipping costs

The direct cost of returning the products is borne by the Consumer, pursuant to art. 57, paragraph 1 of the Consumer Code.

We strongly recommend using a tracked and insured shipping service: the Consumer is responsible for the goods until they are actually received at our warehouse.

6. Condition of returned products

Products must be returned:

  • in their original packaging, intact and complete with all accessories, manuals and documentation;
  • in conditions that allow them to be resold;
  • without signs of use that go beyond the mere inspection necessary to establish the nature, characteristics and functioning of the product.

The Consumer is responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the product, pursuant to art. 57, paragraph 2 of the Consumer Code. In such cases, the Seller reserves the right to deduct from the refund an amount proportionate to the diminished value.

7. Refund

Once the returned products have been received and their condition verified, we will issue the refund without undue delay and in any event within 14 days from the day on which we were informed of the decision to withdraw.

The refund will include the price of the returned products and any standard delivery costs incurred at the time of purchase. Any additional costs resulting from the choice of a delivery type other than the standard option offered will not be reimbursed.

The refund will be issued by bank transfer or credit note, as agreed with the Consumer. The Consumer will not bear any cost for the refund.

We reserve the right to withhold the refund until we have received the goods back or until the Consumer has supplied evidence of having sent back the goods, whichever is the earliest.

8. Exclusions from the right of withdrawal

Pursuant to art. 59 of the Consumer Code, the right of withdrawal does not apply, among other things, to contracts for the supply of:

  • goods made to the Consumer’s specifications or clearly personalised;
  • sealed goods which are not suitable for return for hygiene or health protection reasons and which have been unsealed after delivery;
  • goods which, after delivery, are by their nature inseparably mixed with other items;
  • goods or services whose price is dependent on fluctuations in the financial market that cannot be controlled by the Seller;
  • goods liable to deteriorate or expire rapidly.

9. Statutory warranty of conformity

All products sold on our website are covered by the statutory warranty of conformity provided for by art. 128 et seq. of the Consumer Code for Consumers (duration: 26 months from delivery, with the obligation to report the defect within 2 months of its discovery), and by the warranty for defects in the sold goods pursuant to art. 1490 et seq. of the Italian Civil Code for B2B customers (notification within 8 days of discovery, expiry after 1 year from delivery).

In the event of a lack of conformity, the Customer is entitled, at his or her choice and within the limits of the law, to repair or replacement of the goods, or alternatively to a price reduction or termination of the contract. To activate the warranty, please contact customer service at the addresses indicated in Section 1, attaching: proof of purchase, a description of the defect and photographs where relevant.

10. Dispute resolution

For any complaint, the Consumer may contact our customer service at the details indicated in Section 1.

Pursuant to EU Regulation 524/2013, Consumers residing in the European Union have the right to access the European Commission’s Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr.

For disputes that cannot be settled amicably, the competent court is that of the place of residence or domicile of the Consumer, if located in Italy. For B2B customers, the exclusive competent court is that of Milan.

11. Model withdrawal form
